Conditions of Participation
NOTE: The color-highlighted paragraphes were added or slightly modified on 29 March 2013.
These Conditions of Participation define the contractual agreement between the editors of »DER GREIF« (Karlstetter Simon Robert, Kirchlechner Leon, Lohscheidt Sven Matthias GbR; Short form: Der Greif GbR) and the applicants/participants who submit their work for publication in the magazine »DER GREIF« and/or on the corresponding website »www.dergreif-online.de«.
1. ACCOUNT
In order to submit works for the photo magazine »DER GREIF«, the applicant must create a user account on the website »www.dergreif-online.de«.
By creating a user account, I agree to receive confirmations, reminder and messages about a possible publication of may work.
I commit myself to keep my login information secret in order to avoid abuse by third parties.
The editors of »DER GREIF« reserve the right to delete individual user accounts if it seems necessary.
2. SUBMITTED WORK
2.1. PUBLICATION OF SUBMITTED WORK
I authorize the editorial staff of the photo-magazine »DER GREIF« to publish my works, that is, all texts and photos I submit, in the photo-magazine »DER GREIF« and on the corresponding website »www.dergreif-online.de«. If there are several issues of »DER GREIF« scheduled, I can confer the right to use each photo for one or more planned issues.
I agree that images of the final layout of the magazine can be used for digital or printed advertisment for the magazine or related events.
I agree that sole the editorial staff is in authority to take decisions as to the manner in which my photos and/or texts shall be integrated into the lay-out and that design issues are exclusively and entirely incumbent upon them.
I note that »DER GREIF« does not guarantee the actual publication of my photos and/or texts.
2.1.1 SPECIAL CASE: COVER PICTURE
In case one of my photos is chosen to be the cover picture, I authorize the editorial staff of the photo-magazine »DER GREIF« to cut out a detail, in order to render possible a constant appearance of all covers.
Furthermore I agree to the application of the cover-image for promotion-, press- and merchandising-material (e.g. postcards, tote bags, etc.) for the photomagazine »DER GREIF«.
2.2. ADMINISTRATION AND DELETION OF SUBMITTED WORK
Before the end of the entry deadline for a certain issue, I have the opportunity to edit or delete those works which I have submitted for this issue.
IMPORTANT: After the entry deadline, i.e. during the ongoing curation and creation process of an issue of »DER GREIF«, for which I have submitted work, it is not possible to to edit or delete submitted works.
2.3. ARCHIVING OF SUBMITTED WORK
I agree that the work I have submitted for a certain issue of »DER GREIF« regardless of a publication – will be archived by the the editorial staff of »DER GREIF«. I may revoke this consent via mail or e-mail to redaktion@dergreif-online.de. In the event of cancellation, the work will be deleted immediately after the appearance of the affected issue of »DER GREIF«.
3. PERSONAL DATA
3.1. PUBLICATION OF PERSONAL DATA
I agree to the publication of my full name and the URL of my website in the photo-magazine »DER GREIF« and on the website »www.dergreif-online.de«.
All other contact information will NOT be published.
3.2. STORAGE OF PERSONAL DATA
All submitted personal data will be stored for the purpose of adminsitration, curation and organization. Personal data will NOT be forwarded to third party.
3.3. DELETION OF PERSONAL DATA
I can delete my account on the website “www.dergreif-online.de”. With the deletion of the account and all my personal data be deleted.
IMPORTANT: If I delete my account after the submission deadline, i.e. during the ongoing curation and creation process of an issue of »DER GREIF«, for which I have submitted work, my account will be deleted after completion of that issue.
In case of publication of some of my submitted work in a magazine of »DER GREIF«, I agree that the staff of »DER GREIF« is allowed to keep my name and my contact saved. This is necessary, because I am still responsible for my submitted work after the deletion of my account. So the staff of »DER GREIF« needs furthermore the ability to contact me.
4. DECLARATION OF COPYRIGHT
I assure that I am the solitary author of all texts and/or photos submitted to the editorial staff.
5. AUTHORIZATION FOR PUBLICATION
I assure that the pictured people agree with the publication of their portraiture.
I assure that the parents of pictured children agree with the publication of their children’s portraiture.
I assure that I do not impinge upon any personal rights of any third person by my submitted work.
I assure that I have the right to submit pictures of places, buildings, landscapes, military installations or operations, means of transport, goods, persons in order to be published as described in paragraph 2.1.
6. DISCLAIMER
I am liable for all submitted work.
I indemnify the editorial staff of »DER GREIF« from any claims of any third person.
I am liable for any damage caused particularly by the violation of articles 4 and 5.
7. ACQUIRING COPIES
In case of publication of my work in the following issue of »DER GREIF«, I will receive one free copy of this issue.
8. SEVERENCE CLAUSE
If any provision of this agreement is invalid, the validity of the remaining provisions shall not be affected. Both parties agree to arrange a regulation which comes as close as possible to the invalid provision.
9. JURISDICTION AND APPLICATION OF LAW
Place of general jurisdiction is Augsburg. German law is applied. The german text is juridical valid.
